Proskauer Secures Unanimous Victory at the New York Court of Appeals on Behalf of Three Legal Services Organizations
In a unanimous ruling, the New York Court of Appeals invalidated regulations that would have established a new state-operated system allowing parents to place their children with individuals outside their family. The Court concluded that the proposed “Host Homes” programme unlawfully removed fundamental protections afforded to children and parents under New York State’s statutory voluntary foster care framework.
